Expert Witness and Dispute Resolution
Hardie Brack has an established and recognised expertise in providing advice to the Courts on general and specialist property matters. We act for claimants and defendants and are often instructed on a single joint expert basis. When acting as Expert Witness, we adopt fully the requirements of the Civil Procedure Rules and RICS Practice Statement and Guidance Note – “Surveyors acting as expert witness”. Our Chartered Surveyors have provided Exert Witness advice and presented evidence in the Court of Appeal, High Court, County Court, Crown Court and Magistrates Court on property related matters including:
- Commercial property disputes
- Housing disrepair and Section 11 claims
- Dilapidations disputes
- Construction disputes
- Boundary disputes
- Japanese Knotweed damage dispute
- Clinical negligence accommodation requirements
We also act as expert witness in alternative dispute resolution situations including arbitration, adjudication and mediation. We regularly provide advice to planning enquiries and land tribunals
We have extensive experience in preparing schedules of condition and dilapidations and negotiating claims through to a successful conclusion. We provide a regular service to many established clients in the commercial and retail sectors. We fully adopt the Dilapidations Protocol and our detailed knowledge of building pathology, landlord and tenant legislative requirements and building works costs ensure effective documentation is available to both our landlord and tenant clients.
We provide a comprehensive access audit and consultancy service in accordance with National Register of Access Consultants (NRAC) requirements.
We undertake Access and Equality Audits taking full account of the Equality Act guidance and Codes of Practice. We can advise on employer and service provider obligations and requirements to undertake reasonable adjustments.
We act as Expert Witness in disputes involving access and provide guidance on design and property adaptation requirements for disabled and special users.
Hardie Brack have extensive experience in providing advice on Party Wall matters and acting as Party Wall Surveyor. We provide advice on the implementation of the Party Wall Act to developers and adjoining owners.
We have acted as Party Wall Surveyor on both single residential projects and major commercial developments.
We will serve Party Wall Notices, prepare schedules of condition and coordinate the Party Wall requirements through to issue of the Party Wall Award document.
Fire Risk Assessments
Hardie Brack regularly undertakes Fire Risk Assessments on commercial and multi-occupied residential properties. We provide an effective and comprehensive service to building and property portfolio owners and managing agents. Our detailed reports ensure compliance with current legislation and anticipated future obligations.
Health and Safety/CDM
Hardie Brack are fully conversant with the requirements of the CDM Regulations and associated Health and Safety legislation and regularly act as Principal Designer on residential and commercial projects.
We can provide initial advice on application of the CDM Regulations, Employer obligations and notification requirements on small works and major development projects.
Our design consultancy will always include advice on energy efficient solutions to your building project. Building Regulations Part L compliance is a requirement but we will also guide on opportunities for greater energy efficiency and the benefits that can be achieved.
Hardie Brack can also provide residential energy appraisals and EPC certificates.
